Abstract
This written testimony was prepared for a hearing of the U.S. Senate Judiciary Committee, Subcommittee on the Constitution. The hearing was entitled "Secret Law and the Threat to Democratic and Accountable Government," and was held on April 30, 2008. In the testimony, I discuss how the U.S. Constitution balances secrecy's dangers against the need for some government secrecy. I explain that many actions of the current administration subvert this careful constitutional design.
