The Enduring Importance of Police Repression: Laojiao, the Rule of Law and Taiwan's Alternative Evolution

Abstract

This paper reviews the policies with respect to criminal justice in the wake of the 1989 Pro Democracy Movement in the People’s Republic of China and, specifically, the extent to which the power to imprison remains firmly within the grasp of the police without significant prosecutorial or judicial involvement. We use the contrasting example of Taiwan to demonstrate an alternative path.
