Abstract

This paper discusses the development and function of article 31(3)(C) VCLT as well as its application by the courts (most notably the ICJ) and its specific cogency for environmental law. Furthermore, the Pulp Mills case, a case on point, is examined since this ruling is illustrative of the difficulties connected to the functioning of Article 31(3)(c).
