Mediation and Post-Election Litigation: A Way Forward

Abstract

This article argues, against conventional wisdom, that mediation has a place in post-election disputes. The key is disaggregating post-election disputes into outcome-determinative disputes versus process disputes. While mediation is not advised for the former, using mediation to resolve post-election process disputes holds promise.
