Abstract
This chapter discusses the Endangered Species Act's role in the United States' legal response to climate change. For readers who are not already familiar with the statute, it begins with an overview of the ESA. The bulk of the chapter then discusses how the Fish and Wildlife Service and the National Marine Fisheries Service — the two administrative agencies primarily responsible for implementing the ESA — and the courts have begun addressing the ESA’s application to climate change.
