Abstract
Recurrently debated is whether law is a mere business, or whether law is somehow different, i.e., that law is a profession. At first blush this issue may appear, although academic, essentially irrelevant; however, such is not the case at all. The answer to this query appears to dictate many of the rules governing the conduct and liability of lawyers. In this article I will analyze this issue, attempt to prove that it is an incorrect method of analysis and will offer analysis of two recent cases, using a different approach.
One of the strangest twists to this debate is that its very phrasing begs an answer that disparages the practitioner of law and confuses who is and is not a professional. Please allow me to elaborate...
