Abstract:
In re Trusted Net Media is a significant involuntary bankruptcy case because it holds that 11 U.S.C. 303(b) is not subject matter jurisdictional and, therefore, is not a threshold question that a bankruptcy court needs to decide before exercising jurisdiction over a case. In deciding that 303(b) requirements are not subject matter jurisdictional the 11th Circuit elected to ignore a plethora of contrary case law.
