Abstract:
Copyright laws were never intended to create absolute monopoly. These laws create an equilibrium between the rights of copyright owners to generate profits for their work and the benefits that accrue to the society from learning and building on their works. The traditional principles of copyright like the 'fair use' doctrine were developed towards this end. With the advent of Information and Communication Technology revolution, these traditional principles are losing their relevance. There is a wholesale transformation of copyright laws with the adoption of many layers of protections in the form of - technological protection measures - and also through contract laws.

Abstract:
Though the main objective of the Trademark law is to protect the business goodwill and reputation, the ultimate benefactors are the public. Trademark as a badge of origin, acts as an identifier of the quality of the products thereby helping the public avoid any confusion about the source of the products. There has always been expansion in the scope of the marks, which are registered as trademarks. Trade dress is an example of this expansion. The concept of trade dress has much importance in a country like India where majority of the people are still illiterate. Trade dress helps the illiterate, who cannot read the trademark on the product as well as the manufacturers, to reach their customers easily.
