Who wins and who loses in the Roberts' Court? For example, "Citizen's United " based its decision in part on the need for voters to have information about candidates. "Shelby County" invalidated a part of the Voting Rights Act because it treated some states less well than others. "NFIB" ruled the spending power could not to used to "extort" the states. But states' rights got short shrift in "Trinity Lutheran". Is this just ad hoc decision making or is there a hierarchy of values?
