Raju Rajiv Gandhi School of Intellectual Property Law, IIT Kharagpur August 1, 2008 ESSAYS ON THE FUTURE OF THE WORLD TRADE ORGANIZATION - (Vol. 1) Policies and Legal Issues, pp. 303-332, Julien Chaisse and Tiziano Balmelli, eds., Geneva: Edis, 2008 Abstract: The purpose of the WTO Agreement on Anti-Dumping (ADA) is to ensure that the provision is used only as a contingency measure based upon merit, and not as a veiled protectionist mechanism. However, since the establishment of the WTO in 1995, the number of anti-dumping investiigations initiated has increased substantially. Given the growing misuse of anti-dumping investigations, there is an urgent need to look into the modification of the procedure, and the current analysis attempts to identify the broad areas of violation of the ADA in world trade and subsequently discusses the potential provisions for future reform.
