Abstract:
Islamic criminal policy has progressive view on crime, guilty and victim, and it's based on Quran and Sunnah, so when researchers search in Islamic law they can find most powerful theories in criminology, but we don't see Islamic criminologist and Islamic criminology as independent branch of Islamic criminal law. It's come from Muslim Jurisconsult idea, because they emphasis on punishment and crime, so they don't think about reason of crime and socialization of guilty. When you think about punish the guilty, you don't think about "why he/she does that crime?"

Though, we can't find some novel idea in Islamic jurisprudence such as environmental prevention, victimology, social defence and etc. Now I'm trying to educe Islamic criminology from Islamic rules and policy, so in this paper I'm trying to have comparative study on Islamic theories and legal theories.

Keywords: Islamic criminology, Islamic policy, criminology theories
