Abstract:     
The European Court of justice upheld the validity of the Framework decision on the European Arrest Warrant, whose inconsistency with fundamental rights was often claimed before several national supreme and constitutional courts of the Member States of the EU. The judgment of the Court is particularly important also because it is the first preliminary ruling on validity according to Article 35 of the EU Treaty.
