Abstract:     
Substantial publicity and an equity market in freefall have provided a colourful backdrop for the Government to reassess the long standing "hands off" approach to the regulation of margin lending. Last year's Green Paper on Financial Services and Credit Reform (Green Paper) recognised "considerable and growing concern" for these products "which are not regulated under specific legislation either at State or Commonwealth level."2. Given that the Corporations Act will apply to "margin loans" from 1 July 2009, there is a concern that there is not enough time to undertake the required review of each provision within the Corporations Act to consider its suitability and applicability to margin lending.
