Threats, Glorification of Terrorism and Freedom of Expression - The Case De Juana ChaosAbel Arias Castañoaffiliation not provided to SSRN October 22, 2007 InDret, Vol. 4, 2007 Abstract: This paper examines, from a constitutional point of view, the decisions of the Spanish National Court and the Spanish Supreme Court in the case known as “De Juana Chaos”. It analyzes the criteria applied by these Courts when applying the “Threats”, “Terrorist Threats”, and “Glorification of Terrorism” crimes and the freedom of expression issues they involve. Adopting a critical position to the line of arguments used by the courts, the paper demands the use of basic interpretative principles in the field of fundamental rights with this category of cases.
