The Meaning of Discrimination Under Title VII: A Review of Supreme Court Interpretation

Abstract:     
In general, Title VII of the Civil Rights Act of 1964 prohibits employment discrimination based on race, color, religion, sex and national origin. While the language of the statute is fairly straightforward, the courts have had a very difficult time figuring out what those apparently simple words mean. The United State Supreme Court has had to make the difficult choices that have to be made between motive, on the one hand, and effects of employer conduct, on the other. This article examines the Supreme Court decisions interpreting Section 703 of Title VII and the meaning of discrimination.
