Focus on . . . The Effect of USERRA on Retirement PlansDavid A. PrattAlbany Law School 1997 Journal of Pension Benefits, Vol. 5, No. 1, pp. 25-34, Autumn 1997 Abstract: The Uniformed Services Employment and Reemployment Rights Act (USERRA) assures veterans and reservist that they cannot be denied employment benefits because of their military service. USERRA imposes significant obligations on plan sponsors, who must ensure that their human resources and plan administration procedures comply fully with the requirements. Numerous practical problems are not addressed by the legislation, and prompt guidance is needed to clarify, for both employers and veterans, how the new rules will be interpreted. Some suggestions follow.
