Performers' Right: An Issue to Be Addressed

Abstract:     
This paper is aimed to analyze the rights of performers under the current national and international legal framework and to examine whether these rights are enough to protect their interests in appropriate manner or not. A performance is an intellectual creation of the performer in the same manner as the invention of any product or process of the inventor. But the present legal regime does not confer similar rights to the performers. As a result violation of performers’ right is very rampant everywhere in the world and the performers are poorly paid for their work. This is because there is no separate and independent law for the performers. Performers rights are govern by Copyright Laws which in substance does not suit for the works of performers. Therefore, in this paper the author has suggested a sui generis law exclusively for the performers.
