Abstract:     
I explain the foundations of the right to non discrimination in commercial establishments as a human right under the laws of Guatemala. I also explain how the rights to property, freedom of industry and freedom to contract do not support an owner's right to select his clientele in an absolute manner. I explain how the "right of admission" usually recorded on a sign outside the door or in the general contracting terms seeks to denaturalize the discussion as transfer the analysis of this right from the field of human rights (where rights are enforced) to the field of contractual law (where rights are bargained for). I conclude that the discussion ultimately belongs in the field of human rights, and therefore not subject to negotiation.

Refuto la existencia de un derecho absoluto de los propietarios para seleccionar a su posible clientela. Explico como la reserva el derecho de admisión no encuentra justificación en las regulaciones de los derechos a la propiedad, libre comercio e industria y libertad de contratación. Explico como la reserva al derecho de admisión pretende variar la posición jurídica de un propietario hacia una invitación para ofertar. Esto pretende trasladar el análisis de la admisión desde el ámbito de derechos humanos (en donde se exige) hacia el derecho de las obligaciones (en donde se negocia). Expongo como esta situación no es susceptible de corrección económica y requiere la participación de los tribunales.
