Abstract:
The code of ethics which governs the legal profession regulates attorney advertisements. In general, attorney advertisements cannot mislead or create an unjustified expectation of results. There is a new type of legal advertisement being scrutinized by several states. The advertisements provide that an attorney was chosen for a publication which lists those attorneys who are the best in their respective area of law. Several states have considered whether these advertisements violate the code of ethics. This article reviews the issue and the 1st Amendment protections for commercial speech.
