Abstract:
The present article analyzes the proposal of the draft of the Chilean Penal Code, elaborated by the Penal Forum, commission created by the Ministry of Justice, in matter of generic aggravating circumstances. It presents the general characteristics of the the circumstances modifying of liability in the actual Code and its regulation in the draft. Then de article analyzes the treachery, the payment, reward or promise and malice, that represent the catalogue of aggravating of the proposal. Finally, it examines the destiny of the aggravating circumstances that were not included in the draft.
