Abstract:     
Uses the cases of Viking and Laval to compare E.U. proportionality to U.S. balancing. Describes the problems of legal reasoning, justification, and hierarchization of fundamental (constitutional) (human) rights. Applies the Coase theorem to constitutional and treaty adjudication.
