Origin and Evolution of the Concept of Genocide (Origen y Evolución Del Concepto Del Genocidio)Najman Alexander AizenstatdUniversidad Rafael Landivar; Yale Law School June 19, 2007 Revista de Derecho de la Universidad Francisco Marroquín, No. 25, p. 11, 2007 Abstract: The term genocide is frequently used in a wide sense, therefore its content is not always clearly defined. In this paper I explore the legal elements of the crime of genocide, considering the interpretation of the ad hoc tribunals. Considering the historical legacy of the term I conclude that some wide interpretations, and particularly those used outside a legal context, dilude the exceptional gravity of the term. However, even if some actions do not satisfy the elements of the crime of genocide, they may still be prohibited by other crimes. La palabra genocidio frecuentemente se usa en forma amplia, de tal forma que no es claro su significado. En este papel exploro los elementos legales de tipificación del delito, considerando las interpretaciones de los tribunales ad hoc. Tomando en cuenta el legado historico de la definición señalo que algunas interpretaciones y en particular aquellas utilizadas fuera del contexto legal diluyen la gravedad excepcional del término. Sin embargo aún que no concuerden con los elementos del delito de genocidio, varios actos graves pueden estar prohibidos por otros delitos.
