Where Should the Citations Go?

Abstract:
Should citations go in the text or in footnotes? I asked Michigan lawyers to vote on side-by-side passages that were identical except for placement of the footnotes. (See http://ssrn.com/abstract=1777506.) This article reports the results—and the story behind the survey. It also argues for footnoted citations.
