Child, Please - Stop the Anti-Queer School Bullycides: A Modest Proposal to Hoist Social Conservatives by Their Own 'God, Guns, and Gays' PetardDavid GroshoffWestern State University College of Law March 1, 2011 University of Maryland Law Journal of Race, Religion, Gender & Class, Forthcoming Abstract: In the final four months of 2010, at least twelve bullied gay/lesbian/bisexual/transgender (“queer”) students committed suicide (“bullycide”) after suffering prolonged hostile schoolground violence (“HSV”). Addressing that crisis, this Article advances queer rights by using conservative legal and moral ideologies that the dominant socio-legal majority traditionally applied against queer people, thereby hoisting them by their own petard. The initial law review article addressing anti-queer HSV and bullycide appeared in 1986. Since then, legal advocates have pursued tactics to deter anti-queer HSV that failed to speak sufficiently of “nefarious discriminatory purposes,” gender-exclusive “deliberate indifferences,” or deprivations “of the right not to bullied,” under §1983, Title IX, and anti-bullying statutes. A minority culture cannot relate successfully with its dominant culture, if the two do not speak a mutually understandable language. By bridging theory, praxis, and linguistic divides, this Article shifts the dialogue from the failed heuristic lexicon historically employed by queer and critical legal theorists and instead structures a legal paradigm based on the socially conservative language of “God, guns, and gays” employed by the George W. Bush Justice Department as well as some current government officials. Put simply, this Article argues that enduring socially conservative Judeo-Christian deontological teachings (God), underscored by the Supreme Court’s opinion last year in McDonald v. City of Chicago, which incorporated a fundamental right to bear arms in self-defense (guns), collectively justify a legal and moral right to exert lethal force at school by bullycidal queer students (gays).
