The rules on the international jurisdiction provided in Article 1051, 1065 point 3 and 1066 paragraph 2, point 5, letter d of the new Civil Procedure Code use both the concept of habitual residence and the concept of domicile. Comparing Articles 87 and 2570 of the new Civil Code and considering the development of the habitual residence concept in the Private International Law, we conclude that the two concepts are synonyms in the contemporary Romanian Law. The three articles of the Civil Procedure Code should be revised. A remedy should be found in keeping only the concept of habitual residence.
