Abstract:     
This paper argues that it is a mistake to rely on due diligence as a yardstick to determine whether states have complied with their obligation to prevent and punish violations of women’s rights under CEDAW. The standard of positive obligations employed by the European Court of Human Rights is clearly to be preferred.
