Abstract:
The second of four articles comparing an example from the Federal Rules of Evidence with the "restyled" version. After summarizing why most legal drafting has been so bad for so long, the article identifies 31 drafting deficiencies in Rule 612. The new rules are scheduled to take effect in December 2011.
