Abstract:
This book chapter, co-written with Prof. Marjorie Aaron, discusses new empirical data which suggests that most lawyers value a mediator giving analytic and evaluative comments in legal mediations. It goes on to analyze the benefits and dangers of using evaluative techniques; discusses whether and when to evaluate; and gives prescriptive advice about how to structure and deliver evaluative comments without alienating disputants.
