Abstract:
The law on perfection and maintaining perfection of security interests in manufactured (mobile) homes is complex. Depending on the state, it may require a personal property filing in the UCC records, the recording of a mortgage in the county real estate records, a vehicle registration, or a combination of all. While efforts to simplify this area of the law are underway, at present it is a confusing state of affairs that creates inefficiencies in the manufactured home industry. This paper discusses the law in this evolving area of commercial activity.
