Contract Damages in Montana Part II: Reliance and Restitution

Abstract:     
This article surveys Montana statutes and case law with respect to the reliance interest and the restitution interest. It finds that the application of these interests has been encumbered by a system founded on a Code that does not give express recognition to them. It urges courts and lawyers to become more aware of the flexibility offered by thee remedial tools.
