Abstract:
In an increasing number of states, unconstitutional searches and seizures will trigger not only the federal exclusionary rule, but also the state’s more liberal exclusionary rule. This article addresses the issue that arises when the search occurs in one state, but the prosecution takes place in another state. The author posits it as a conflict of laws problem raising a choice of law question.
