Drafting in the Contracts Class

This issue of the St. Louis University Law Journal featured Contracts professors writing about what they do in the first class meeting. I recommend all of the articles! Mine discusses how I begin to introduce drafting concepts into the course on the first day. I begin by taking the students through the steps of buying something on eBay, which requires them to agree to the eBay terms and conditions. I then ask them to role-play the buyer and the seller of the item and negotiate a contract. This sets the stage for many of the concepts we will deal with in the course, the principal one being the difference between a contract of adhesion and a negotiated contract.
