Agricultural Liens Under Revised Article 9

Revised Article 9 attempted to include agricultural liens within its ambit, even though agricultural liens are created by statute rather than by contract. Unfortunately, the UCC revision did not mesh with the Montana statutory lien scheme, producing a conflict between the two schemes that the author predicted would cause a conflict that would have to be resolved through litigation. The article contains suggestions for resolving this litigation, and for harmonizing the statutory schemes to avoid future problems.
