Discovery of Persons Wrongfully Confined

Abstract:     
This paper is on the subject of discovery of persons wrongfully confined. A wrongful act is an unlawful act. Liberty of persons is to be protected and in discovering a detenue the manner is to remain lawful, proper and honest. Section 100 of the Code of Criminal Procedure, 1898 is the relevant provision of law which authorises specified magistrate to act and no other authority is competent to proceed under that section. Law has taken all the care that was reasonable in the matter of exercise of this power. A Magistrate cannot issue a search warrant unless he has reason to believe that a person is wrongfully confined and the confinement amounts to an offence.
