Shariah and Fundamental Rights: The Nigerian Experience

Abstract:     
This paper critically examines the principles of human rights under Shari’ah Law vis-a-vis the current understanding of the principles in the received English Law which is the dominant Law in the Nigeria Legal System. It identifies the extent to which some of principles in Shari’ah Legal System are in divergence from that of the received English Law and whether the application of such principles are relevant to Nigeria. The paper is divided to two sections, that is; Fundamental Human Rights in Shari’ah Legal System and, Shariah and Nigeria Legal System.
