Abstract:     
Article written in a leading (peer-reviewed) IP law review in The Netherlands on the interplay between .nl-domain name dispute resolution policy and mandatory provisions in Benelux and Community trademark law barring arbitration. The article contends that the proposed .nl-domain name dispute resolution policy violates those provisions and is therefore illegal.

Note: In response to this article in 2003 and a previous article by the same author in 2002 ("http://ssrn.com/abstract=2003773"), the Dutch .nl-domain name authority (SIDN) changed its policy in 2008 and replaced it with a ADR policy similar to the UDRP.
