Honest Services Update: Directors' Liability after Skilling and Black

Abstract:     
Honest services law was dramatically altered in 2010 when the USSC issued three rulings, of which 2 (Skilling and Black) directly impact on director liability. This article examines director liability after these two cases redefine what honest services fraud may be, and how this impacts on accountability.
