Mediation and Post-Election Litigation: A Way ForwardRebecca GreenWilliam & Mary Law School February 1, 2012 Ohio State Journal on Dispute Resolution, Vol. 27, p. 53, 2012 William & Mary Law School Research Paper No. 09-210 Abstract: This article argues, against conventional wisdom, that mediation has a place in post-election disputes. The key is disaggregating post-election disputes into outcome-determinative disputes versus process disputes. While mediation is not advised for the former, using mediation to resolve post-election process disputes holds promise.
