First Circuit Vacates Textron Work-Product Privilege Ruling and Grants Petition for Rehearing En BancDouglas StranskySullivan & Worcester LLP; Boston University Graduate Tax Program March 3, 2009 Practical U.S./Domestic Tax Strategies, 2009 Abstract: This article reports that a majority of the judges of the Court of Appeals for the First Circuit voted on March 25, 2009 to hear the Textron work-product privilege case en banc. As a result, the court withdrew the panel opinion and the dissent, and vacated the judgment entered on January 21, 2009. The court scheduled the en banc hearing for June 2, 2009.
