Abstract:     
This paper, written for a seminar in Natural Resource Law, analyzes the 2012 U.S. Supreme Court case PPL Montana, LLC v. Montana. It poses and answers the question of why portage defeats navigability for title but facilitates navigability for regulatory jurisdiction.
