Juridical Ideology and Its Influence upon the 'Or Sameach's' Halachic Decision Making Process

Abstract:     
הרשימה מבקשת לשרטט אידיאולוגיות משפטיות ועקרונות רוחב משפטיים החולשים על יצירתו ההלכתית של הרב מאיר שמחה הכהן מדוינסק (האור שמח, 1843- 1926), מניעים אותה ומשפיעים עליה. בתוך כך תוצג גישתו האידיאולוגית המשקיפה על ההלכה בעיניים מהותיות ולא פורמליסטיות. גישה זו מתפרטת לכמה ענפים ובכללם: נטיית האחדה והכללה של מקרים שונים תחת דין אחד, העדפת תוצאה מהותית וצודקת על פני דבקות בתקינות ההליך הפרוצדוראלי, והתייחסות לשיעורים הלכתיים כשיעורים גמישים בעלי רקמה פתוחה. בצד אלו תוצענה גישות אידיאולוגיות נוספות, המשתלבות בגישה מהותית זו, ומשפיעות אהדדי.

This article explores broader juridical concepts in the Or Sameah and Meshech Chochma writings. I showed how the picture of R. Meir Simhah HaKohen from Dvinsk slowly came to together becoming more distinct and filled with many colorful shades and hues: seemingly analytical statements in the Meshech Chochma joined with normative ones in the`Or Sameah to create underlying, fundamental principles, halakhic statements in one chapter of the `Or Sameah joined with ones in another to create a complete unique approach.
