Abstract:     
'אור שמח' - הלכה ומשפט משנתו של הרב מאיר שמחה הכהן על משנה תורה לרמב"ם ספר זה הוא מונוגרפיה מחקרית ראשונה על חיבורו של הרב מאיר שמחה הכהן מדווינסק - 'אור שמח' על משנה תורה לרמב"ם. הספר עומד על מגמות החיבור, בוחן הלכה אחר הלכה, ודולה את העקרונות ההלכתיים - משפטיים שהנחו את הרב מאיר שמחה הכהן בחיבורו. הספר מציע פרדיגמות ומודלים חדשים, ומראה כי האור שמח משכלל באופן שיטתי את כתיבתו ההלכתית של הרמב"ם ומפתח אותה אל מעבר להלכתו של הרמב"ם. הספר בוחן את דרכי פיתוח הקודיפיקציה הרמב"מית וחושף מגמות פסיקה עצמאיות של האור שמח, הנעות בין קבלה וסמכות לבין חידוש ויצירה. הספר בוחן גם את יחסו המיוחד של האור שמח לתלמוד הירושלמי כמקור להכרעת הלכה, את יחסם של הפוסקים המאוחרים לכתיבתו ההלכתית, ואת פעולתו הנורמטיבית בחיבורו הפרשני על חמישה חומשי תורה, 'משך חכמה'. ספר זה שופך אפוא אור חדש על חיבור 'אור שמח'.

This book is the first scholarly monograph about the composition of Rabbi Meir Simcha Hacohen of Dvinsk's work, Or Sameah, a commentary of the Maimonides’ Mishneh Torah. The book analyzes the trends, examines the commentary section by section, and explores the halakhic and legal principles that guided Rabbi Meir Simcha Hacohen in his work. The book offers new paradigms and models, and shows that Or Sameah systematically elaborates the halakhic writing of Maimonides and develops it beyond the Maimonides' halakhic. The book examines the methods of development and codification of Maimonides' rules and reveals character traits independent of the Or Sameah's commentary, which range from acceptance and authority to innovation and creativity. The book also examines the Or Sameah's special treatment of the Jerusalem Talmud as a source of judgment, the attitude of the later halakhic authorities toward his writing, and the normative action in his commentary on the Pentateuch, Meshech Chochma. So this book sheds new light on the Or Sameah.
