Abstract
In this article the author analyses if actual family property law still translate the common sense and values of today's society, by giving a rough sketch of some important issues that have pointed out in the last decades, first in matrimonial property law, then in inheritance and gift law, all part of family property law. At the end he presents a new deal to deal with this issues. Therefore he states that will be necessary: a shift from matrimonial to relation property law; a reorientation of imperative rules from less in inheritance law to more in relational property law; a three-track inheritance law, both intestate and imperative.
