Small business and individual researchers, as well as Universities involved in innovation (R&D) face dilemas between making public their results via IP rights (here, patents), or managing them as trade secrets. When a patent is violated its holder faces very relevant expenses to defend it. Private patent insurance can be help innovation. This paper offers a systematic approach to different types of patent insurance as well as a legal and actuarial model to the introduction of patent insurance in average innovator countries such as Spain.
