Abstract:

This article, now published in Portuguese (and adapted from earlier work), reviews the comparative sociology of women lawyers, arguing for the feminization of the legal profession in many countries. Women are now over 50% of law graduates in many countries and serve in many different legal roles, including the judiciary, civil service, private practice, as prosecutors and government officials, as well as public interest lawyers. But, it is still true that despite their growing numbers in the profession in so many countries, women are still disproportionately under-represented in the most prestigious parts of the profession, depending on what is prestigious in different legal cultures. The article reports on the participation rates of women in different parts of the legal profession in many different countries and then reviews the claims, by this author and others, that the growing number of women in the legal profession might have an impact on how law is practiced and how the legal system might be adapted, both in substance and in process, drawing on feminist legal and social theory, as well as data.
