Abstract

Spanish Abstract: El 31 de octubre de 2006 la Asamblea General de las Naciones Unidas adoptó por consenso la Convención Internacional para la protección de todas las personas contra las desapariciones forzadas. Es el primer instrumento jurídicamente vinculante de alcance universal en la materia y ha venido a colmar un vacío legal en la materia. A su vez, implica un reconocimiento de que las desapariciones forzadas no son un fenómeno del pasado ni exclusivo de las antiguas dictaduras latinoamericanas. La Convención Internacional ha recogido los desarrollos doctrinarios y jurisprudenciales más progresistas que la sociedad civil venía reclamando desde hace tiempo. Por lo tanto, desde un punto de vista teórico estamos en presencia de un instrumento internacional que posee las herramientas adecuadas para hacer frente al fenómeno desapariciones forzadas o involuntarias.

English Abstract: On October 31, 2006 the United Nations General Assembly adopted by consensus the International Convention for the protection of all persons against enforced disappearances. The Convention is the first universal binding treaty and has come to fill the legal vacuum surrounding this issue. At the same time, it means recognition that enforced disappearances are neither a phenomenon of the past nor an exclusive tool of the former Latin America military juntas. The International Convention has included in its text high standards of human rights protection recognised by the doctrine and international tribunals and claimed for long time by the civil society. Thus, from a theoretical point of view we are in presence of an international treaty with the proper tools to face the phenomenon of enforced disappearances in the world.
