Abstract
תקציר בעברית: רשימה זו דנה בשאלה אם יש להטיל על תובע ייצוגי נטל לפנות לנתבע לפני הגשת בקשה לאישור תובענה כייצוגית. בית הדין הארצי לעבודה השיב לה לאחרונה בחיוב. הדעה המובעת ברשימה היא שהטלת נטל כזה אינה יעילה מאחר שהוא יפגע בתמריץ להגיש תובענות ייצוגיות יעילות; בכוחו של מכשיר התובענה הייצוגית למלא את תכליותיו; ושניתן להשיג את מטרת הנטל – לוודא שבקשה לאישור תובענה ייצוגית תוגש לאחר בדיקה הולמת של התשתית הצריכה לעניין – בדרכים אחרות, עדיפות.
English Abstract: The question discussed in this paper is whether a plaintiff should be required to give notice to the defendant prior to filing a class action. The Israeli National Labor Court has recently answered this question in the affirmative. The paper argues that such a requirement is inefficient, as it will decrease the incentive to file efficient class actions, as well as the ability of the class action mechanism to fulfill its purposes. It is further argued that the goal of such a requirement – ensuring that class actions are only filed after a thorough examination of the factual foundation – can be accomplished using other, preferable, means.
