Abstract

Polish Abstract: Celem niniejszej pracy jest wyodrębnienie i omówienie tych elementów polityki zewnętrznej UE, w których widoczna jest kwestia ochrony praw podstawowych. Zanim jednak wskazana materia zostanie poddana analizie, zasadne stało się prześledzenie rozwoju praw podstawowych w unijnym porządku prawnym, biorąc pod uwagę w szczególności orzecznictwo Europejskiego Trybunału Sprawiedliwości (ETS lub Trybunał) oraz zmiany w prawie pierwotnym UE.

Artykuł zwraca uwagę także na status praw podstawowych i ich umocowanie w Traktacie o Unii Europejskiej (TUE) i Traktacie ustanawiającym Wspólnotę Europejską (TWE). Po tych uwagach wstępnych, prawa podstawowe są omówione kontekście stosunków zewnętrznych UE. Wyróżnia się następujące płaszczyzny działania UE w zakresie istotnym dla tematyki artykułu: (a) instrumenty o charakterze konsensualnym, oparte o zasadę warunkowości; (b) autonomiczne instrumenty finansowe dotyczące praw podstawowych; (c) autonomiczne środki regulacyjne: ogólne preferencje taryfowe; (d) prawa podstawowe a państwa kandydujące; oraz (e) sankcje implementowane lub nakładane przez UE.

English Abstract: The aim of this paper is to pinpoint and analyze elements of the external policy of the European Union pertinent to the protection of fundamental rights. Firstly, it addresses certain preliminary issues, such as: (a) the development of the fundamental rights in the European Union legal order, including the jurisprudence of the European Court of Justice and the changes introduced to the founding EU Treaties; (b) the legal status of fundamental rights in the EU legal order.

Secondly, fundamental rights are characterized, taking into account the following spheres of activity of the EU: (a) consensual instruments that contain the principle of conditionality; (b) autonomous financial instruments that relate to fundamental rights; (c) autonomous regulatory instruments: generalized tariff preferences; (d) fundamental rights and candidate countries; and (e) autonomous EU sanctions or those implemented by the EU.

The paper concludes that there are certain inconsistencies in the application of fundamental rights in the EU external policy. In particular it shows that, notwithstanding the universal and indivisible character of fundamental rights, there are in fact treated separately and with varying degrees of 'intensity', for various reasons, in different EU policies.
