Abstract

German Abstract: Hunderte von Abkommen, die seit 1922 im Rahmen der internationalen Arbeitsorganisation erarbeitet wurden, sollen Belangen der Arbeiter dienen. Die Interessen der Arbeiter könnten potentiell durch die Gewähr und Durchsetzung subjektiver internationaler Rechte befriedigt werden. Dieses Teilrechtsgebiet kann also in der Perspektive der subjektiven internationalen Rechte analysiert werden. Die Idee des subjektiven internationalen Rechts («unterhalb» der Normstufe der internationalen Menschenrechte) könnte hier sowohl eine Erklärungskraft entfalten als auch normativ einen Beitrag zum verbesserten Schutz leisten. Die Fragestellung lautet also, inwiefern das bereits existierende Arbeitsrechtsregime solche Rechte gewährt, inwiefern sich diese von den internationalen Menschenrechten unterscheiden und inwiefern die Arbeiterrechte, als eigene Kategorie verstanden, operationeller sind als allgemeine Menschenrechte.

English Abstract: Hundreds of agreements which have been concluded since 1922 under the auspices of the International Labour Organization seek to protect labourers’ concerns. The interests of labourers may potentially be satisfied through granting and enforcing international individual (‘subjective’) rights. This special field of international law can thus be analysed from the perspective of individual rights. The idea of the subjective international right, ‘below’ the level of human rights, might here be both an analytic tool and contribute normatively to improved protection. The question therefore is whether and where the existing regime of labour rights already confers such rights (entitlements), to what extent these are distinct from human rights, and whether international labourers’ rights, understood as a separate category, are more operational than human rights.
