German Abstract: Das Referendum auf der Krim im März 2014 steht in der Tradition zahlreicher Gebietsreferenden, die vor allem in Osteuropa in den vergangenen 25 Jahren abgehalten wurden. Demokratische Verfahren der Gebietszuteilung unter Berücksichtigung des Willens der betroffenen Bevölkerung sind zwar störungsanfällig, bei Einhaltung rechtsstaatlicher Prinzipien aber besser als alle anderen Alternativen. Auf der Krim wurden jedoch elementare Durchführungsregeln verletzt. Daher ist das Referendum völkerrechtlich irrelevant. Es handelte sich um eine „comédie plébiscitaire“ zur Verbrämung der militärischen Besetzung und der anschließenden Annexion der Halbinsel durch Russland.

English Abstract: The March 2014 referendum in the Crimea stands in the tradition of numerous territorial referendums that have been held in Eastern Europe over the past 25 years in particular. Allocating territory in democratic processes with due consideration of the will of the affected populations may be difficult to implement in practice. However, if such referendums are properly embedded in the rule of law, then they are a better procedure for realizing a territorial status change than all other modes ranging from a purely inter-state consent to the imposition by Great Powers.

In Crimea, however, elementary international rules for conducting a territorial referendum were violated. Therefore, the referendum is irrelevant under international law. It was a "comédie plébiscitaire" to disguise the military occupation of the peninsula and its subsequent annexation by Russia.
